Palestinians in general and Gaza civilians in particular have seen some of the worst acts of genocide in history since October 7. Hospitals, medical facilities, schools, and food supplies have all been damaged by the occupation, which has resulted in approximately 48,000 fatalities and over 92,000 injuries. The occupation has failed in its attempts to drive the people of Gaza away, despite the horrible crimes it has committed and the amounts of munitions it has showered on them. Even after 11 months of aggression, the majority of Palestinians continue to support the "Al-Aqsa Flood" operation, demonstrating that the occupation has not been able to eradicate public support for the resistance. There is a great unanimity among Palestinians about the resistance option.

 

The Palestinian people believe that negotiations would not result in a peace agreement given the numerous war crimes carried out by the occupation, ranging from the original seizure of their territory to the most recent attack in Gaza. They believe that using armed resistance and fighting the Israeli occupation is the right course of action. The operation on October 7 was a suitable reaction to the death that was all around them, in every sense of the word. Armed resistance is the only choice left to the Palestinian people; it is justified by international law and entails inflicting material and human losses on the occupiers as a reasonable reaction. This is exacerbated by the dissatisfaction caused by the lack of political opportunities and optimism that the occupation—which includes the settlement development in the West Bank and the siege of Gaza—has ruined. Because of this, most people think that Hamas is the most qualified party to lead Gaza and to oppose the occupation.

International law has accorded all occupied peoples the right to legitimate defense and the freedom to resist occupation via all available means, including armed resistance, on the basis of their rights to existence, self-determination, and survival. The occupants of occupied regions are not prohibited by law from employing weapons or from taking part in national or resistance activities against the occupation. Conversely, peoples are required by international conventions and treaties to confront and put an end to the occupation of their territory. Furthermore, the occupation is regarded by international charters and treaties as an authority that was founded by force rather than by law. Therefore, whatever form it takes, force is the only way to remove this occupation.

 

Additionally, international law unequivocally upholds the right to actively engage in opposing occupation forces, defending the nation-state and its freedom, honor, and dignity, and refusing to submit to occupation rules and regulations. The fundamental foundations that support peoples' rights to resist occupation are the UN Charter and the Hague Conventions of 1899 and 1907. Furthermore, the legitimacy of peoples' movements was officially endorsed by UN General Assembly Resolution 2649 of 1970. The General Assembly of the United Nations affirmed the validity of the struggle by which peoples recognized as having the right to self-determination, but under colonial and foreign oppression, have reclaimed that right by any means necessary. It believes that it is unacceptable and a blatant violation of the Charter for territories to be acquired and retained against the will of their people to self-determination."
